Description: This memorandum conveys information in response to inquiries from hospitals and critical access hospitals (CAHs) concerning implications of COVID-19 (coronavirus disease) for their compliance with the Emergency Medical Treatment and Labor Act (EMTALA). This guidance applies to both Medicare and Medicaid providers. Every hospital or CAH with a dedicated emergency department is required to conduct an appropriate medical screening examination of all individuals who come to the emergency department, including individuals who are suspected of having COVID-19.
